RESULT OF AN APPEAL (EDDIE AHERN) HEARD BY THE APPEAL BOARD ON MONDAY 29TH JULY 2013

1. On 29th July 2013 the Appeal Board of the British Horseracing Authority heard an Appeal by Eddie Ahern against the decision of the Disciplinary Panel dated 22nd May 2013, whereby it was determined that Ahern had committed breaches of Rules (A)41.2, (B)59.2 and (A)36.2 of the Rules of Racing.

2. The Grounds of Appeal were:

(i) That the Reasons given by the Panel were insufficient to support their decision;
(ii) That there was insufficient evidence to support certain findings made by the Panel including the finding that Ahern had deliberately ridden the gelding JUDGETHEMOMENT (USA) to lose in its race at Lingfield on 21st January 2011; and
(iii) That the sanctions imposed were disproportionate to the conduct found to have occurred such that no reasonable Panel would have imposed them.

3. The Appeal was dismissed with a direction that the resolution of any issue as to costs be deferred to a later date.
