Notice of a forthcoming Disciplinary Panel hearing (Graham Bradley and Brendan Powell)

Licensed trainer Brendan Powell and registered member of stable staff Graham Bradley have been informed they are to be charged with breaches of the Rules of Racing, as follows:

Brendan Powell

1. Whether, in breach of Rule (A)37 of the Rules of Racing, Brendan Powell assisted, encouraged or caused Graham Bradley:

a. To train horses to run in races which took place in England, Wales and Scotland, despite Graham Bradley not holding a trainer’s licence granted by the Authority in accordance with the provisions of the Trainer Manual (C), and thus to act in breach of Rules (A)14 and/or (C)1 of the Rules of Racing; and/or

b. To (i) train horses despite not holding a trainer’s licence granted by the Authority in accordance with the provisions of the Trainer Manual (C), and/or (ii) run such horses in races under the name of Brendan Powell as Trainer when in fact such horses were being trained by Graham Bradley, and thus to act in breach of Rule (A)30.

2. Whether Brendan Powell acted in a manner prejudicial to the integrity, proper conduct or good reputation of horseracing in Great Britain, and so in breach of Rule (A)30 of the Rules of Racing, by allowing horses (i) to be listed at Weatherbys as being trained by him, and/or (ii) to run in races under his name as Trainer, when in fact such horses were being trained by Graham Bradley.

Graham Bradley

1. Whether, in breach of Rule (A)14 and/or Rule (C)1 of the Rules of Racing, Graham Bradley trained horses to run in races in England, Wales and Scotland, despite not holding a trainer’s licence granted by the Authority in accordance with the provisions of the Trainer Manual (C).

2. Whether by (i) training horses despite not holding a trainer’s licence granted by the Authority in accordance with the provisions of the Trainer Manual (C), and/or (ii) running such horses in races under the name of Brendan Powell as Trainer, Graham Bradley acted in a manner prejudicial to the integrity, proper conduct or good reputation of horseracing in Great Britain, and so in breach of Rule (A)30 of the Rules of Racing.

3. Whether, in breach of Rule (A)37 of the Rules of Racing, Graham Bradley assisted, encouraged or caused Brendan Powell to act in a manner which is prejudicial to the integrity, proper conduct or good reputation of horseracing in Great Britain (and so in breach of Rule (A)30 of the Rules of Racing) by assisting, encouraging or causing Brendan Powell to allow horses (i) to be listed at Weatherbys as being trained by Brendan Powell and/or (ii) to run in races under the name of Brendan Powell as Trainer, when in fact such horses were being trained by Graham Bradley.
Notes to Editors:
1. BHA will not comment any further or release any further detail relating to these charges, pending a disciplinary hearing.

2. BHA received an application for a trainer’s licence from Graham Bradley on 28 May 2013. However, this application has not been, and will not be, considered while an ongoing investigation regarding the applicant is being conducted. Graham Bradley is aware of this.

3. Both Graham Bradley and Brendan Powell have been aware of the details of the investigation.

4. A date for the hearing has not yet been set. A timetable for the Inquiry process will be agreed in the near future.

5. BHA will not at this stage release the names of the horses involved or the races in which they ran while BHA alleges they were being trained by Graham Bradley. This information will be revealed after the hearing has concluded and a decision is published by the Disciplinary Panel.

6. This is the first occasion upon which charges have been brought against individuals for training horses without a licence and against individuals for assisting others to train horses without a licence.
