AMATEUR RIDER GORDON GALLAGHER CHARGED WITH BREACHES OF THE MOBILE PHONE RULES

Amateur rider Gordon Gallagher has been informed that the Disciplinary Panel of the Authority will hold an enquiry to consider whether or not he has committed breaches of Rule 140B of the Rules of Racing in the light of Instruction F5 headed “Use of Mobile Telephones by Riders, Master Jockeys’ Valets and Master Valet’s Assistants on Racecourse Property” in that he used his phone outside the “phone zone” at Fontwell on 3rd February 2008. It will also consider his failure to provide itemised telephone records, as subsequently requested by the Integrity Services department, for all mobile telephones in his possession for the afternoon in question.

1. A breach of Rule 140 B has a penalty in the range of £350 – £2,000.

2. The Fontwell Stewards held an enquiry on the day as follows:
MR E ARKELL, Clerk of the Course, reported to the Stewards that he had seen MR G GALLAGHER using his mobile phone outside the Owners and Trainers Bar prior to Race 3. They interviewed the jockey and having heard evidence from MR J BUCHANAN, Weighing Room Security Officer and MR J PAXMAN, Acting Steward, they referred the matter to the BHA.
