NOTICE OF A FORTHCOMING DISCIPLINARY PANEL HEARING, JIM BOYLE / NEW DEN

Licensed trainer Jim Boyle has been informed he will be required to attend a Disciplinary Panel hearing to consider possible breaches of the Rules of Racing relating to the presence of a Prohibited Substance.

The Disciplinary Panel will consider whether or not Jim Boyle is in breach of:

Rule (C)50 by reason of the presence of a Prohibited Substance (namely available carbon dioxide at a concentration in excess of 36 millimoles per litre in plasma) in the samples of blood taken from NEW DEN at Lingfield racecourse on 6 April 2011

Rule (C)37, Rule (B)20 and Schedule (B)3 part 7.1 by virtue of the administration to NEW DEN on race day of ‘a substance’ (namely an alkalising agent) other than normal feed and water by mouth without seeking and obtaining dispensation from a Veterinary Officer

Rule (C)13 by virtue of his failure to keep a record of a ‘Treatment’ for NEW DEN (namely the administration of alkalising agents) to NEW DEN on 5 and 6 April 2011 which included the information listed in Rules 13.2.1 to 13.2.6 for such Treatment

Rule (A)27 in administering, or allowing or causing to be administered, or conniving at the administration of, a prohibited substance, namely an alkalising agent, to NEW DEN either with the intention to affect the racing performance of NEW DEN or in the knowledge that the racing performance of NEW DEN could be affected by such administration

Additionally, the Disciplinary Panel will consider whether, by attempting to attribute the positive sample taken from NEW DEN at Lingfield racecourse on 6 April 2011 to the administration of a ‘tie up’ powder on 5 and 6 April 2011, did Mr Boyle:

– mislead or attempt to mislead the BHA in connection with the administration or control of racing in breach of Rule (A)31 .2, and/or;

– provide inaccurate and incomplete information to the BHA in connection with the administration or control of racing in breach of Rule (A)31.1

A Disciplinary Panel hearing is scheduled to take place on Monday 26th March until Wednesday 28th March 2012.
