Result of an appeal (D Crosse) and an enquiry (J Candlish) heard by the Disciplinary Panel on Thursday 20 August

The Disciplinary Panel of the British Horseracing Authority (BHA) on Thursday 20 August 2015 considered an appeal lodged by David Crosse, the rider of KADALKIN (FR), unplaced, in the mdlutilities.co.uk Handicap Hurdle Race on 15 August 2015, against the decision of the Stewards at Market Rasen to find him in breach of Schedule (B)6 Part 2 of the Rules of Racing in that he had used his whip when out of contention and to suspend him from riding for five days.
The Panel considered evidence from Crosse who was legally represented. It also viewed recordings of the race.
The Panel found, and it was not disputed that Mr Crosse used his whip three times approaching the two furlong marker, when he was one from last. Mr Crosse stated that he felt at that point that he could still pass horses in front of him, and that KADALKIN (FR), whom he knew to be one-paced, needed to be ‘kept rolling’. In the circumstances he argued that these three hits were reasonable and proportionate, and resulted in him passing three more horses.
The Panel concluded that Mr Crosse did not use his whip in either an appropriate or proportionate manner given that he gave the horse three strong hits within a reasonably short space of time when he was out of contention. The Panel accepted that eventually he passed three horses on the run-in, but considered that was due more to those horses being eased.
The Panel dismissed the appeal and confirmed the five day suspension on Saturday 29 and Monday 31 August, Tuesday 1, Wednesday 2 and Thursday 3 September 2015. It ordered that the deposit be returned.
Jennie Candlish
The Disciplinary Panel of the BHA held an enquiry on Thursday 20 August 2015 into a report that RAGING BEAR (USA), trained by Jennie Candlish, had refused to race in the Get Free Bet Offers At thebookiesoffers.co.uk Handicap Stakes at Chepstow on 30 June 2015.
The matter was referred to the BHA by the Chepstow Stewards following their enquiry of the same day, because the gelding had also refused to race at Wolverhampton on 29 April and Doncaster on 28 March. The gelding subsequently refused to race again at Wetherby on 13 July 2015. Having considered the evidence, the Panel declared that with immediate effect under Rule (F)66, no further entries would be accepted for RAGING BEAR for all races run under the Rules of Racing.
